Terms and Conditions for Tucson Tree Doctors

These Terms and Conditions (“Agreement”) govern the provision of tree care services by Tucson Tree Doctors (“we,” “us,” or “our”) to our clients (“Client” or “you”). By requesting or accepting our services, you agree to be bound by these terms.

1. Services Provided

Tucson Tree Doctors offers a range of tree care services, including but not limited to:

•Tree Trimming and Pruning

•Tree and Saguaro Removal

•Cactus Care and Moving

•Arborist Diagnostics and Treatment

•Deep Root Fertilisation

All services will be performed in a professional manner, adhering to industry best practices and safety standards.

2. Estimates and Pricing

•Free Estimates: We provide free, no-hassle estimates for our services. These estimates are based on the information available at the time of assessment.

•Pricing: The final price for services will be confirmed in a written proposal. Any additional work requested by the Client or required due to unforeseen circumstances (e.g., hidden obstructions, severe weather conditions) may result in additional charges, which will be communicated and agreed upon before execution.

3. Client Responsibilities

•Property Access: The Client must ensure clear and safe access to the work area for our equipment and personnel.

•Utility Identification: The Client is responsible for identifying and marking all underground utilities, irrigation lines, sprinkler systems, and other hidden obstructions prior to the commencement of work. Tucson Tree Doctors is not responsible for damage to unmarked or undisclosed underground systems.

•Permits and Permissions: The Client is solely responsible for obtaining any necessary permits, consents, or permissions required by local authorities or property owners before work begins. Delays or fines due to lack of permits are the Client’s responsibility.

•Work Zone Clearing: The Client must remove all personal items, decorations, furniture, and other valuables from the work zone before our crew arrives. We are not liable for damage to items not removed from the work area.

•Final Decision: The Client retains the final decision regarding tree management and assumes all associated risks once services are completed.

4. Payment Terms

•Payment Due: Payment in full is due upon completion of services, unless otherwise agreed upon in writing.

•Late Fees: Invoices not paid within [e.g., 30] days of the invoice date may be subject to a late fee of [e.g., 5%] per month or the maximum rate permitted by Arizona law.

•Collection Costs: The Client is responsible for all costs incurred by Tucson Tree Doctors in collecting overdue balances, including reasonable attorney’s fees and court costs.

5. Limitation of Liability

•Inherent Risks: Tree care services involve inherent risks. While we take all reasonable precautions, we are not liable for damage or injury resulting from future tree failures, unpredictable tree behaviour, or acts of nature after services are performed.

•Tree Health: We do not guarantee the long-term health, stability, or survival of any tree. Trees are living organisms susceptible to environmental factors, pests, and diseases beyond our control.

•Property Damage: We will take reasonable care to prevent damage to your property. However, minor disturbances to lawns, landscaping, or paved surfaces may occur during the course of work. We are not liable for such minor disturbances or for damage caused by conditions beyond our control (e.g., wet ground conditions).

6. Cancellation Policy

We request at least 24 hours’ notice for service cancellations. If a crew has been dispatched to the job site without prior notice of cancellation, a mobilisation fee of [$X.XX] may be assessed to cover incurred expenses.

7. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona. Any disputes arising under this Agreement shall first be addressed through good-faith negotiation. If a resolution cannot be reached, the parties agree to participate in mediation in Arizona. If mediation is unsuccessful, disputes shall be submitted to binding arbitration in Arizona. The prevailing party in any arbitration or legal proceeding shall be entitled to recover reasonable attorney’s fees and costs.

8. Acceptance

By hiring Tucson Tree Doctors for services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
